HIT 102 Legal Aspects of Health Information

1. Describe the concepts of jurisdiction and the authority of the courts in medical legal proceedings.
2. Monitor and adapt to changes in federal, state, and local laws and regulations and/or accreditation standards.
3. Adhere to the legal and regulatory requirements related to the health information infrastructure.
4. Differentiate between the legal health record and the designated record set.
5. Identify patients’ rights in regards to consent, access, disclosure and advanced directives.
6. Maintain a legally defensible health record.
7. Apply retention and destruction policies for health information.
8. Apply policies and procedures for access and disclosure of health information.
9. Develop, implement, and monitor security systems to ensure patient confidentiality in manual and automated health information systems.
10. Release patient–specific data to authorized users.
11. Maintain user access logs/systems to track access to and disclosure of identifiable patient data.
12. Participate in in-service education programs for departmental and non-departmental staff regarding confidentiality, consents, Advanced Directives and other health information issues.
13. Identify the required components of authorizations and informed consents.
14. Describe the role of quality and risk management in liability and legal issues.
